Waterfowl HQ Terms of Use

Effective Date: September 21, 2026

Last Revised: October 12, 2026

Terms Version: 1.1

These Terms of Use (the "Terms") govern access to and use of the Waterfowl HQ mobile application, related websites, content, subscriptions, features, notifications, and services (collectively, the "Service") provided by HQ Outdoor Labs LLC, doing business as Waterfowl HQ ("HQ Outdoor Labs," "Waterfowl HQ," "we," "us," or "our").

1. Acceptance of These Terms

By downloading, accessing, purchasing, subscribing to, accepting these Terms within the app, or using the Service, you agree to these Terms and acknowledge the Waterfowl HQ Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of another person or organization, you represent that you have authority to bind that person or organization to these Terms.

The Service may present additional notices, disclosures, or acknowledgments for particular features, including Waterfowl Activity, subscription data retention, and ice-condition logging. Those feature-specific notices supplement these Terms.

2. Apple App Store License and Standard EULA

Waterfowl HQ distributed through Apple's App Store is licensed, not sold.

Unless HQ Outdoor Labs expressly provides a Custom End User License Agreement through Apple, the license to use the Waterfowl HQ application is also subject to Apple's Standard Licensed Application End User License Agreement (Standard EULA) and applicable Apple Media Services terms.

Apple's Standard EULA is available at:

https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

These Terms supplement, and do not replace, Apple's applicable license terms. If these Terms conflict with Apple's Standard EULA regarding the license to use the application, Apple's applicable license terms control to the extent of that conflict.

3. Eligibility and Use by Minors

You must be legally capable of agreeing to these Terms.

Waterfowl HQ is not directed to children under 13. If you are under the age of legal majority where you live but are otherwise legally permitted to use the Service, you may use it only with the permission and active supervision of a parent or legal guardian who agrees to these Terms.

The Service does not authorize a minor or any other person to possess, transport, or use firearms, boats, vehicles, hunting equipment, or other regulated items contrary to applicable law or without required supervision.

4. Purpose of the Service

Waterfowl HQ is a planning, organization, recordkeeping, and informational tool for waterfowl hunters and outdoor users.

Depending on availability and subscription level, features may include hunt logs, saved locations, weather information, Waterfowl Activity estimates, gear records, maintenance or charging reminders, checklists, license-information storage, decoy-spread planning, photographs, notes, and related tools.

The current launch build does not provide a radar display or severe-weather alert service. Those features may be added, changed, or removed in a future version.

The Service is not an emergency-warning system, professional weather service, navigation service, ice-safety service, wildlife-management authority, legal service, emergency-response service, or substitute for training, licensing, official instructions, scouting, personal observation, or sound judgment.

5. Outdoor Activities and Assumption of Risk

Hunting, boating, wading, driving, traveling in remote areas, exposure to severe weather, use of firearms, use of equipment, and travel on or near ice involve inherent and potentially serious risks.

These risks may include property damage, becoming lost or stranded, hypothermia, drowning, falls, vehicle or boat accidents, firearm injuries, bodily injury, permanent disability, and death.

You remain solely responsible for evaluating conditions, obtaining appropriate training, using properly maintained safety equipment, following official instructions, and deciding whether an activity can be undertaken safely.

No feature, score, forecast, map, reminder, saved record, notification, location, or other information from the Service should be treated as a guarantee that an activity, route, body of water, weather condition, piece of equipment, location, or hunting plan is safe.

6. Weather and Waterfowl Activity

Weather observations and forecasts may be supplied by Apple WeatherKit and other third-party or government data sources.

Waterfowl Activity may combine local weather conditions with regional migration-weather inputs, seasonal context, algorithms, scoring, and other available information to produce informational estimates such as an Activity Index, Migration Push score, Local Flight Conditions score, Seasonal Migration score, forecast-confidence rating, suggested movement window, or explanatory reasons.

Waterfowl Activity is an informational estimate, not a probability or guarantee of seeing or harvesting waterfowl.

Waterfowl movement is influenced by many variables outside HQ Outdoor Labs' control, including hunting pressure, food availability, roost disturbance, water levels, ice conditions, habitat changes, weather variability, migration timing, and local conditions.

Scores, activity levels, migration indicators, confidence ratings, and suggested movement windows are not guarantees of waterfowl presence, movement, migration, or hunting success.

Local or migration-related weather information may be delayed, incomplete, inaccurate, unavailable, inconsistent, or geographically imprecise. A higher confidence rating does not mean a prediction is guaranteed to be correct.

Waterfowl HQ does not currently provide severe-weather warnings or emergency alerts. Never rely on Waterfowl HQ as your sole source of weather or safety information. For hazardous weather, monitor official government alerts, local authorities, emergency information, weather radio when appropriate, trusted media, and actual conditions around you.

7. Ice Conditions and Ice Observations

Any ice entry, thickness selection, label, estimate, note, photograph, or observation stored in a Hunt Log is user-entered recordkeeping information only.

Waterfowl HQ does not measure, test, calculate, verify, certify, predict, or recommend ice thickness, ice strength, load-bearing capacity, or whether ice is safe for any person, animal, vehicle, or equipment.

Ice thickness and strength can vary substantially over short distances and can change rapidly because of current, springs, vegetation, structures, temperature, precipitation, snow cover, wind, water level, and other factors.

A recorded thickness from one time or location must not be applied to another time or location. You are solely responsible for avoiding unsafe ice and consulting official authorities, trained local experts, and direct current measurements before making any decision.

8. Hunting Laws, Licenses, and Ethical Conduct

You are solely responsible for knowing and following all applicable federal, state, provincial, tribal, local, refuge, conservation-area, and private-property rules.

These may include seasons, zones, legal shooting hours, species identification, harvest limits, possession limits, methods, ammunition restrictions, permits, licenses, stamps, reporting duties, trespass laws, boating rules, firearm laws, and safety requirements.

Information stored or displayed by the Service is not legal advice and does not establish that your license, permit, activity, location, equipment, or planned hunt is lawful.

Consult the responsible government agency and current official regulations before acting.

9. Maps, GPS, Locations, and Saved Places

Coordinates, addresses, map features, saved locations, location names, property boundaries, water features, access points, and other geographic information may be inaccurate, outdated, incomplete, or unavailable.

The Service does not establish property ownership, public access, navigability, legal boundaries, road conditions, landowner permission, water depth, safe ice, or emergency-location accuracy.

Always obtain required permission, verify boundaries and access using authoritative sources, obey posted restrictions, and carry appropriate navigation and communication equipment. Do not rely exclusively on a mobile device in remote or hazardous conditions.

10. Gear Records and Reminders

Gear records, serial numbers, battery information, maintenance reminders, charging reminders, and local iOS notifications are organizational tools only.

A reminder may be delayed, suppressed, duplicated, unavailable, or never delivered because of device settings, operating-system behavior, permissions, power state, notification settings, or other factors outside HQ Outdoor Labs' control.

You are solely responsible for inspecting, maintaining, charging, repairing, storing, transporting, and using equipment according to manufacturer instructions and applicable law.

Never assume equipment is functional or safe merely because no reminder appeared or because a record shows that service was completed. Inspect safety-critical equipment before use.

11. No Emergency or Professional Services

The Service does not contact emergency responders, monitor your safety, track you for rescue, or guarantee that anyone knows your location.

If you face an emergency or immediate threat, contact 911 or the appropriate local emergency service and follow official instructions.

Do not use Waterfowl HQ as a substitute for emergency communications, professional advice, certified instruction, official weather warnings, or an emergency action plan.

12. Your Content and Records

You may enter or store hunt records, photographs, notes, partner names, locations, gear information, serial numbers, license information, decoy plans, and other information ("User Content").

You retain ownership of your User Content. You are responsible for its accuracy, legality, appropriateness, and for having permission to include information relating to another person.

HQ Outdoor Labs does not acquire ownership of locally stored User Content merely because you use the Service.

You should maintain independent backups of any information you consider important. Device loss, device damage, application deletion, storage limitations, corruption, software changes, confirmed subscription expiration, or other events may result in permanent loss.

HQ Outdoor Labs does not guarantee recovery, retention, synchronization, or backup of User Content unless a specific feature expressly states otherwise.

Backup Login is an alternative method of unlocking Waterfowl HQ. It is not a backup, synchronization, recovery, or cloud-storage service for User Content.

Do not use the Service to store information when disclosure could create an unreasonable safety or security risk. Protect your device, passcode, Apple Account, backups, and access to sensitive records.

13. Waterfowl HQ Pro Data Retention and Expiration

Waterfowl HQ Pro includes, among other benefits, continued retention of Waterfowl HQ user-created app data while the subscription remains entitled.

Turning off auto-renewal or otherwise canceling Pro does not immediately end an already-paid subscription period. Pro access and stored Waterfowl HQ data remain available through the end of the current paid-through period as verified by Apple StoreKit.

When Waterfowl HQ can verify that an active Pro subscription with auto-renewal turned off is within its final three days, the app is designed to display an in-app warning telling the user to renew to continue Pro services and retain stored Waterfowl HQ data.

The warning is a convenience and is not guaranteed to be displayed if the app is not opened, subscription information cannot be verified, the device is unavailable, app presentation is unavailable, or other technical conditions prevent presentation.

When Apple StoreKit authoritatively confirms that a previously entitled Waterfowl HQ Pro subscription has ended and any applicable Billing Grace Period has expired, Waterfowl HQ may automatically and permanently delete user-created Waterfowl HQ data stored by the app on that device.

Returning from Waterfowl HQ Pro to the Free tier does not preserve only the amount of data ordinarily permitted under the Free-tier limits. When the expiration conditions described above are authoritatively confirmed, Waterfowl HQ may delete all user-created Waterfowl HQ data covered by the reset process, including records that otherwise would have fit within the Free-tier limits.

For example, a former Pro user should not expect Waterfowl HQ to preserve the first five hunt logs, first five gear items, one license, two checklists, two saved decoy spreads, two saved locations, or other records merely because those amounts would ordinarily fit within the Free-tier limits.

The deletion may include hunting logs, app-stored photographs, harvest and band information, hunting-partner information, gear records, gear photographs, maintenance information, checklists, licenses, app-stored license photographs, saved decoy spreads, spread photographs, notes, saved locations, local reminders, planner drafts, thumbnails, Backup Login credentials, and other locally stored user-created Waterfowl HQ records covered by the reset process.

Once this deletion occurs, the deleted information cannot be recovered by HQ Outdoor Labs. Later re-subscribing, restoring purchases, or later billing recovery does not restore data already deleted from the device by Waterfowl HQ.

Waterfowl HQ is designed not to delete stored data merely because a device is offline, Apple services are unavailable, a network request fails, or subscription status is unknown. An unknown or unavailable subscription status is not treated as confirmed expiration. The app may temporarily restrict access while waiting for authoritative subscription verification rather than delete data based on an unverified status.

Original photographs remaining in the user's Apple Photos library are not deleted when Waterfowl HQ deletes its own stored copies.

Users should maintain independent copies or backups of any information they consider important.

By using Pro and storing User Content in Waterfowl HQ, you acknowledge and agree to this subscription-based data-retention policy.

14. Billing Failure and the 3-Day Billing Grace Period

For eligible subscriptions, Waterfowl HQ is intended to use Apple's 3-day Billing Grace Period when enabled in App Store Connect and made available by Apple.

If a renewal fails because of a billing issue and Apple places the subscription into the Billing Grace Period, Waterfowl HQ will continue to provide Pro access and retain app data through Apple's verified grace-period expiration date.

Waterfowl HQ is designed to display an in-app billing warning during that grace period instructing the user to update payment information to continue Pro services and retain stored app data.

If Apple StoreKit authoritatively confirms that the grace period has ended without recovery and the Pro entitlement is no longer active, the data-deletion policy in Section 13 may be applied.

Apple may continue billing-recovery efforts after the grace period under Apple's policies. If stored Waterfowl HQ data has already been permanently deleted following verified expiration, a later successful billing recovery, renewed subscription, or restored purchase will not restore that deleted data.

Users are responsible for maintaining valid payment information and monitoring their Apple subscription status.

15. Free Features, Advertising, Pro Subscriptions, and Purchases

Waterfowl HQ offers a Free version with feature and saved-data limitations together with paid Waterfowl HQ Pro subscription plans.

The Free version may display third-party advertising through advertising services integrated into Waterfowl HQ. Those advertising services may collect or process certain information as described in the Waterfowl HQ Privacy Policy and the privacy disclosures provided through the Apple App Store.

Waterfowl HQ Pro provides an ad-free experience while the user has an active Pro entitlement.

Pro may also provide unrestricted or expanded access to features and saved data as described in the App Store or in-app purchase screen. If Waterfowl HQ describes a Pro benefit as “unlimited saved data,” that means Waterfowl HQ does not apply the Free-tier saved-record limits to that Pro user. It does not mean HQ Outdoor Labs provides unlimited cloud storage, cloud backup, or cloud synchronization.

Waterfowl HQ currently offers Pro Monthly and Pro Annual subscription options. The subscription name, duration, features, current price, currency, taxes, trial or promotional terms if any, renewal terms, and other purchase disclosures presented by Apple or Waterfowl HQ at the time of purchase control.

The App Store price displayed at the time of purchase is the controlling purchase price and may change as permitted by Apple, applicable law, and these Terms.

Subscriptions purchased through Apple are processed by Apple and automatically renew unless canceled according to Apple's subscription rules.

You can manage or cancel an Apple-billed subscription through your Apple Account subscription settings. Turning off auto-renewal or canceling a subscription ordinarily takes effect at the end of the current paid subscription period rather than immediately.

Cancellation does not override the subscription-based data-retention and deletion provisions described in Sections 13 and 14. If a Pro entitlement later expires and Waterfowl HQ confirms that the applicable conditions for deletion have been met, stored Waterfowl HQ data may be permanently deleted as described in those sections.

Deleting Waterfowl HQ from your device does not automatically cancel an active subscription.

16. Restore Purchases, Refunds, and Billing

Waterfowl HQ may provide a Restore Purchases function for eligible Apple transactions. Restoration depends on Apple's transaction records, the Apple Account associated with the purchase, StoreKit availability, and Apple's applicable policies.

Restore Purchases restores eligible subscription entitlements; it does not restore Waterfowl HQ User Content that was previously permanently deleted from the device under the subscription-retention policy.

Refund eligibility and processing for Apple-billed purchases are governed by Apple's policies and applicable law. HQ Outdoor Labs does not control Apple's refund decisions and does not receive users' full payment-card information.

17. Permission to Use the Service

Subject to these Terms, the Privacy Policy, Apple's applicable Standard EULA, and applicable law, HQ Outdoor Labs grants you a limited, personal, revocable, nonexclusive, nontransferable, and nonsublicensable right to use the Service on devices you own or control for lawful personal purposes.

No ownership interest in the Service is transferred to you. All rights not expressly granted are reserved by HQ Outdoor Labs and its licensors.

18. Acceptable Use

You may not use the Service to:

- Violate law, hunting regulations, property rights, privacy rights, or another person's rights

- Facilitate unlawful hunting, poaching, trespassing, fraud, harassment, stalking, threats, deception, or endangerment

- Gain or attempt to gain unauthorized access to another device, account, system, or data

- Copy, modify, reverse engineer, decompile, scrape, sell, sublicense, redistribute, or commercially exploit the Service except where applicable law expressly permits it

- Introduce malicious code, interfere with operation, bypass feature restrictions, or circumvent subscription controls

- Abuse promotions, reminders, support channels, or other Service functionality

- Use automated means to access the Service in a manner not expressly authorized by HQ Outdoor Labs

19. Third-Party Platforms and Services

The Service may rely on or link to third-party products and services, including Apple, the App Store, StoreKit, WeatherKit, MapKit, Core Location, Google, Google AdMob, Google User Messaging Platform, Cloudflare, NOAA/National Weather Service, Environment and Climate Change Canada, device services, websites, and external links.

HQ Outdoor Labs does not control and is not responsible for the independent availability, accuracy, security, terms, privacy practices, advertising practices, or content of third-party services.

Third-party advertising displayed through Waterfowl HQ Free may be provided by Google or its advertising partners. The appearance of an advertisement does not constitute an endorsement, recommendation, warranty, or guarantee by HQ Outdoor Labs concerning the advertiser, product, service, or claim contained in the advertisement.

Government weather information is used as an input and is not presented as an endorsement of Waterfowl HQ by NOAA, the National Weather Service, Environment and Climate Change Canada, or another government agency.

Your use of third-party services may be subject to separate terms and policies. A link, integration, attribution, advertisement, or display of third-party information does not mean HQ Outdoor Labs guarantees that information, product, service, or third party.

20. Intellectual Property

The Service, including its software, source code, design, interfaces, text, graphics, branding, logos, databases, compilation, predictive or scoring logic, original algorithms, features, and documentation, is owned by HQ Outdoor Labs LLC or its licensors and may be protected by copyright, trademark, trade-secret, and other intellectual-property laws.

Waterfowl HQ, HQ Outdoor Labs, associated logos, slogans, designs, and related branding may not be used without prior written permission except as allowed by law.

Government and third-party data remain subject to the rights and licenses of their respective providers.

If you voluntarily submit feedback, ideas, recommendations, or suggestions, you grant HQ Outdoor Labs a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback to develop, improve, market, or operate its products and services without compensation or obligation to you. This does not transfer ownership of your private User Content.

21. Privacy

Waterfowl HQ’s data practices are described in the Waterfowl HQ Privacy Policy available at:

https://www.hqoutdoorlabs.com/privacy

The Privacy Policy should be read together with these Terms.

Waterfowl HQ does not require an HQ Outdoor Labs online account and HQ Outdoor Labs does not maintain a cloud database containing users’ locally stored hunt logs, gear records, licenses, photographs, saved spreads, notes, or similar in-app hunting records.

Device permissions, including location, photos, camera, notifications, and device authentication, can be controlled through device settings, although disabling permissions may prevent certain features from functioning.

22. Changes, Availability, and Updates

HQ Outdoor Labs may update, modify, add, remove, suspend, restrict, or discontinue parts of the Service at any time subject to applicable law and applicable Apple requirements.

Features may become unavailable because of internet outages, device problems, third-party outages, government-data outages, maintenance, software errors, operating-system changes, App Store changes, legal requirements, or events outside HQ Outdoor Labs' reasonable control.

HQ Outdoor Labs does not guarantee that every feature will remain available, work on every device, support every location, or remain compatible with future operating-system versions or third-party services.

You are responsible for installing appropriate app and operating-system updates.

23. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND.

HQ OUTDOOR LABS DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES TO THE EXTENT THEY MAY LAWFULLY BE DISCLAIMED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, QUIET ENJOYMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

HQ OUTDOOR LABS DOES NOT WARRANT OR GUARANTEE WEATHER INFORMATION, WATERFOWL ACTIVITY SCORES, MIGRATION INDICATORS, CONFIDENCE RATINGS, MOVEMENT WINDOWS, LOCATIONS, MAPS, ICE INFORMATION, REMINDERS, HUNTING INFORMATION, USER RECORDS, SUBSCRIPTION AVAILABILITY, DATA RETENTION, ADVERTISING AVAILABILITY, OR THIRD-PARTY DATA.

Some jurisdictions do not allow certain warranty exclusions. Nothing in these Terms excludes or limits a warranty or statutory consumer right that applicable law does not permit to be waived.

24. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HQ OUTDOOR LABS LLC AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, PROFITS, REVENUE, BUSINESS, GOODWILL, OPPORTUNITY, OR USE; PROPERTY DAMAGE; OR PERSONAL INJURY ARISING FROM OR RELATED TO THE SERVICE, THIRD-PARTY DATA, FAILURE OR DELAY OF A REMINDER OR WARNING, SUBSCRIPTION EXPIRATION, USER DATA DELETION CONSISTENT WITH THESE TERMS, OR YOUR OUTDOOR ACTIVITIES, EVEN IF ADVISED THAT SUCH DAMAGE MAY OCCUR, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT LAWFULLY BE EXCLUDED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF HQ OUTDOOR LABS FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR

(B) ONE HUNDRED U.S. DOLLARS (US $100).

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, and statutory consumer rights remain unaffected where applicable. The limitations apply to the fullest extent permitted even if a remedy fails of its essential purpose.

25. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless HQ Outdoor Labs LLC and its owners, members, managers, officers, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, losses, damages, judgments, costs, and reasonable attorneys' fees arising from your unlawful or negligent use of the Service, your User Content, your material violation of these Terms, your intentional or reckless misconduct, or your violation of another person's rights.

This obligation does not apply to the extent a claim results from conduct for which applicable law does not permit indemnification or liability shifting.

26. Suspension and Termination

You may stop using the Service at any time.

HQ Outdoor Labs may discontinue or restrict online services under its control, block abusive or malicious requests to its service endpoints, or remove or limit Service functionality when reasonably necessary because of misuse, fraud, security concerns, unlawful conduct, legal requirements, third-party service changes, or discontinuation of a feature.

Because Waterfowl HQ does not currently use an HQ Outdoor Labs customer account system, this section should not be read as describing a routine user-account suspension process.

Deleting the app or stopping use does not automatically cancel an App Store subscription. You must manage or cancel subscriptions through Apple’s applicable subscription process.

Sections that by their nature should survive will survive, including ownership, subscription-related data-deletion consequences already triggered, warranty disclaimers, liability limitations, indemnification, governing law, venue, and dispute provisions.

27. Governing Law and Venue

Except where applicable consumer law requires otherwise, these Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

Any court proceeding arising from these Terms or the Service must be brought in the state courts located in Boone County, Missouri, or the United States District Court with jurisdiction over Boone County, Missouri, and each party consents to personal jurisdiction and venue there, except where applicable law requires otherwise.

These Terms do not require mandatory arbitration and do not include a class-action waiver. Any dispute remains subject to the governing-law and venue provisions above except where applicable law requires otherwise.

28. Informal Dispute Resolution

Before filing a lawsuit concerning a dispute that can reasonably be resolved informally, you and HQ Outdoor Labs agree to make a reasonable good-faith effort to resolve the matter through written communication.

This requirement does not prevent either party from seeking urgent or emergency relief when necessary to protect legal rights, property, security, or safety.

29. Apple-Specific Terms

If you access Waterfowl HQ through Apple's App Store, you acknowledge that these Terms are between you and HQ Outdoor Labs, not Apple, except for rights and obligations created by Apple's own terms.

Apple is not responsible for operating, maintaining, or supporting Waterfowl HQ except to the extent Apple expressly assumes obligations under its own terms or applicable law.

Your license to the application is limited to use on Apple-branded products you own or control as permitted by Apple's applicable Usage Rules and Standard EULA, including applicable family-sharing or other Apple-authorized use.

You must comply with applicable third-party terms when using the Service, including the terms associated with your wireless-data, internet, Apple, and other service providers.

Apple and Apple's subsidiaries are intended third-party beneficiaries of the Apple-specific provisions of these Terms to the extent applicable, and may enforce those provisions as permitted by law and Apple's terms.

30. Changes to These Terms

HQ Outdoor Labs may update these Terms to reflect changes in Waterfowl HQ, subscriptions, data-retention behavior, applicable law, Apple requirements, third-party services, or business practices.

Material changes may require users to review and affirmatively accept a revised version before continuing to use Waterfowl HQ.

The Last Revised date and Terms Version identify the current published version.

Continued use following an applicable update constitutes acceptance to the extent permitted by law when renewed affirmative acceptance is not required.

31. Severability, No Waiver, Assignment, and Entire Agreement

If any provision of these Terms is held unenforceable, it will be modified or enforced to the minimum or maximum extent necessary and permitted by law, and the remaining provisions will remain effective.

HQ Outdoor Labs' failure to enforce a provision is not a waiver of the right to enforce it later.

You may not assign these Terms without prior written consent from HQ Outdoor Labs. HQ Outdoor Labs may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, corporate restructuring, or by operation of law.

These Terms, the Waterfowl HQ Privacy Policy, Apple's applicable Standard EULA and App Store terms, and any feature-specific terms or purchase disclosures constitute the applicable agreement concerning use of the Service.

Headings are for convenience only. The words "including" and "include" mean "including without limitation."
